Terms of Service

The agreement between you and ÈkóHacks for using the Dojo

Who you are contracting with

The Dojo is operated by EKOHACKS OÜ, a private limited company registered in Estonia, company number 17182181, of Järvevana tee 9, 11314 Tallinn, Estonia ("we", "us").

Payments are sold and processed by Paddle.com Market Ltd ("Paddle"), acting as merchant of record. Paddle is the seller for your purchase. Paddle appears on your card or bank statement, issues your invoice, and is responsible for collecting and remitting sales tax and VAT. Your purchase is also subject to Paddle's own terms.

What the service does

The Dojo reads activity from source repositories you connect and turns it into metrics, experience points and rank. It shows you how your engineering practice is changing over time, and it lets the person mentoring you see the same picture.

We read from your repositories. We do not write to them, and we do not modify your code.

Eligibility and your account

You must be at least 16 years old to use the Dojo. You sign in with a GitHub account, and we issue no passwords of our own.

Your account is for you. You are responsible for what happens under it and for keeping access to your GitHub account secure. Email connect@ekohacks.com if you believe someone else has used your account.

Acceptable use

You agree not to:

  • Fabricate repository activity in order to inflate metrics, experience points or rank. This includes automated commits, pull requests opened and merged without review for the purpose of scoring, and any other manipulation of the signals the Dojo measures.
  • Resell, sublicense or share your access with anyone else.
  • Attempt to reach another person's data, or any part of the service you have not been granted.
  • Use the service to store or transmit anything unlawful.

We may suspend or close an account for a serious or repeated breach. We will tell you why, and we will refund the unused portion of any period you have already paid for.

Subscriptions, renewal and price changes

Paid plans are billed monthly in advance and renew automatically until you cancel. Prices vary by country, and the price shown at checkout is the price you pay, inclusive of any tax Paddle collects.

If we change the price of a plan you are on, we will tell you at least 30 days before it takes effect, and you may cancel before then. A price change applies only to periods that begin after it takes effect.

Your content and your data

Your code, your repositories and your account remain yours. Nothing in these terms transfers ownership of anything you make.

You grant us permission to read the repository activity you connect, and to store and display the metrics we derive from it, for as long as you use the service. Where you are a member of a cohort, the person leading it can see your metrics. That is the purpose of a cohort, and joining one is your choice.

Availability

We work to keep the Dojo available, and we offer no service level agreement or uptime guarantee.

We may change or remove features. Where a change materially reduces what a paid plan provides, you may cancel and we will refund the unused portion of the period you have paid for.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of data. Our total liability in any twelve month period is limited to the amount you paid us in that period.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

Ending the agreement

You may stop using the Dojo at any time. Cancelling a paid plan returns you to the free plan, and your account stays. To have your account and data deleted, ask us.

We may end this agreement if you breach these terms, or on 30 days' notice if we discontinue the service, in which case we refund any unused prepaid period.

Governing law

These terms are governed by the law of Estonia, and disputes are subject to the courts of Estonia. If you are a consumer resident in the UK or EU, you keep the protection of the mandatory laws of the country you live in, and you may bring proceedings there.

Changes to these terms

We may update these terms. If a change materially affects your rights, we will tell you by email at least 30 days before it takes effect. Continuing to use the service after that means you accept the change.

A refund is available within 14 days of any charge, so a change you dislike is one you can walk away from.
